Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

*Client Accounts** means any third-party platform, account, or service — including but not limited to ecommerce platforms, social media accounts, advertising accounts, email marketing platforms, domain registrars, and hosting providers — to which a Client grants Us access or credentials in order for Us to perform services.
*Company** (referred to as either "the Company," "We," "Us," or "Our" in this Agreement) refers to PICK Branding LLC, Bend, OR.
*Cookies** are small files placed on Your computer, mobile device, or any other device by a website, containing details of Your browsing history on that website among its many uses.
*Country** refers to: Oregon, United States.
*Device** means any device that can access the Service, such as a computer, a cellphone, or a digital tablet.
*Personal Data** is any information that relates to an identified or identifiable individual.
*Service** refers to the Website and any branding, ecommerce, or marketing services provided by the Company.
*Service Provider** means any natural or legal person who processes data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, provide the Service on behalf of the Company, perform services related to the Service, or assist the Company in analyzing how the Service is used.
*Third-Party Social Media Service** refers to any website or social network website through which a User can log in or create an account to use the Service, or through which the Company is granted access to manage content on a Client's behalf.
*Usage Data** refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

*You** means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Collecting and Using Your Personal Data
Types of Data Collected
Personal Data. While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You, including but not limited to: email address, first and last name, phone number, and Usage Data.
Usage Data. Usage Data is collected automatically when using the Service. This may include Your Device's IP address, browser type and version, the pages of our Service that You visit, the time and date of Your visit, time spent on those pages, unique device identifiers, and other diagnostic data. When You access the Service through a mobile device, We may similarly collect device type, unique device ID, mobile operating system, and mobile browser type.
Client Account Access and Credentials. In the course of providing branding, ecommerce, and marketing services, Clients may provide Us with login credentials, API keys, tokens, or direct account access to Client Accounts, including ecommerce platforms (e.g., Shopify, WooCommerce), social media accounts, advertising platforms (e.g., Meta Ads, Google Ads), email marketing platforms, domain registrars, and hosting providers. This may include usernames, passwords, connected payment processor settings, and any content, media, messages, or data stored within those accounts. We access and use Client Account credentials solely to perform the services requested by the Client.
Social Media Access and Content. Where a Client grants Us access to manage its social media accounts, We may view, use, download, edit, schedule, or post content on the Client's behalf, and may access follower/audience data, messages, and analytics associated with those accounts. Separately, if You log in to the Website itself through a Third-Party Social Media Service (see below), We collect the Personal Data associated with that login.
Ecommerce and Customer Data. When engaged for ecommerce work, We may be given access to store data including order history, product catalogs, and Client customers' names, email addresses, shipping addresses, and transaction records. We do not directly store full payment card numbers; payment processing is handled by third-party processors (e.g., Stripe, Shopify Payments, PayPal) under their own privacy and security terms.
Information from Third-Party Social Media Services
The Company allows You to create an account and log in to use the Website through the following Third-Party Social Media Services:
If You register through, or otherwise grant Us access to, a Third-Party Social Media Service, We may collect Personal Data already associated with that account, such as Your name, email address, activities, or contact list. You may also choose to share additional information with the Company through such an account. If You do so, You are giving the Company permission to use, share, and store that information consistent with this Privacy Policy.
Client Authorization and Responsibility
By providing Us with login credentials, account access, or content for any Client Account, the Client represents and warrants that it has full legal authority to grant such access and to authorize Us to act on its behalf — including access to any customer, employee, or other third-party data contained within those accounts. The Client is solely responsible for ensuring that any data shared with Us complies with applicable law and with any agreements the Client has with its own customers, employees, or platform providers. The Company is not responsible for verifying a Client's ownership of, or authority over, any account or data provided to Us, and disclaims liability for claims arising from a Client's lack of authority to grant such access.
Tracking Technologies and Cookies
We use Cookies and similar tracking technologies to track activity on Our Service and store certain information. Tracking technologies used include beacons, tags, and scripts. The technologies We use may include:
*Cookies or Browser Cookies.** A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. If You do not accept Cookies, You may not be able to use some parts of our Service.
*Web Beacons.** Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company to, for example, count users who have visited a page or opened an email, and compile other related statistics.

* Perform branding, ecommerce, and marketing services under a contract with the Client, including managing Client Accounts and any data contained within them.

* Provide news, offers, and information about goods and services similar to those You have purchased or inquired about, unless You have opted out.
* Manage and respond to Your requests.
* Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, in which Personal Data may be among the assets transferred.
* Conduct data analysis, identify usage trends, evaluate the effectiveness of promotional campaigns, and improve Our Service and Client outcomes.
We may share Your personal information in the following situations:
*With Service Providers** to monitor and analyze use of the Service and to contact You.
*For business transfers**, in connection with a merger, asset sale, financing, or acquisition of all or part of Our business.
*With Affiliates**, who will be required to honor this Privacy Policy.
*With business partners**, to offer certain products, services, or promotions.
*With other users**, when You interact in public areas of the Service or register through a Third-Party Social Media Service — other users or Your contacts on that service may see Your name, profile, and activity.

*As required to perform Client-contracted services**, including sharing or entering data into Client Accounts and third-party platforms as directed by the Client.
Third-Party Platforms
Our work necessarily involves interacting with third-party platforms — social media networks, ecommerce platforms, ad networks, hosting providers, analytics tools, and payment processors. Each operates under its own privacy policy and terms of service, independent of Us. The Company is not responsible for the data practices, security incidents, service outages, policy changes, or account actions (including suspension or content removal) of any third-party platform, and We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site or service linked from or connected to the Service.
Retention of Your Personal Data
The Company retains Personal Data only for as long as necessary for the purposes set out in this Privacy Policy, including to comply with legal obligations, resolve disputes, and enforce Our agreements and policies. Usage Data is generally retained for a shorter period, except where needed for security or functionality purposes, or as legally required.
Client Account access, credentials, and related data are retained only as long as needed to perform active services, plus a reasonable period afterward for recordkeeping, unless the Client requests earlier deletion or revokes access. Clients are responsible for revoking or changing credentials upon termination of services if continued access is not desired.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices and wherever the parties involved in processing are located, which may be outside Your state, province, country, or other jurisdiction where data protection laws differ from those of Your jurisdiction. Your consent to this Privacy Policy, followed by Your submission of such information, represents Your agreement to that transfer. The Company will take reasonable steps to ensure Your data is treated securely and in accordance with this Privacy Policy.
Delete Your Personal Data
You have the right to delete, or request that We assist in deleting, the Personal Data We have collected about You. You may update, amend, or delete Your information at any time by contacting Us, or by managing Your Account settings if available. Please note We may need to retain certain information where We have a legal obligation or lawful basis to do so.
Disclosure of Your Personal Data
Business Transactions. If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law Enforcement. The Company may be required to disclose Your Personal Data if required by law or in response to valid requests by public authorities.

Security of Your Personal Data and Client Account Credentials
The security of Your Personal Data, and of any Client Account credentials entrusted to Us, is important to Us. We use commercially reasonable administrative, technical, and physical safeguards to protect such information, including restricted internal access and secure credential storage practices where practical. However, no method of transmission over the Internet or electronic storage is 100% secure, and We cannot guarantee absolute security. Clients acknowledge that providing account access and credentials carries inherent risk, and the Company is not liable for unauthorized access, data breaches, or losses resulting from circumstances beyond Our reasonable control, including breaches occurring at third-party platforms.
Children's Privacy
Our Service does not address anyone under the age of 13, and Our services are intended for businesses and individuals over the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and believe Your child has provided Us with Personal Data, please contact Us, and We will take steps to remove that information from Our servers. Where consent is required as a legal basis for processing and Your country requires parental consent, We may require a parent's consent before collecting and using that information.

Our Service may contain links to other websites not operated by Us. If You click a third-party link, You will be directed to that third party's site.
